this is cnn breaking news. i'm max foster joining you live from london. bianca is off for the day. we've got breaking news to bring you at this hour. it is that essentially the second largest bank failure in american history has been announced. first republic taken over by the authorities late last night. and they have sold a large proportion of the assets to jpmorgan chase. thos those assets we're being told is just announced by the federal deposit insurance agency. that's the agency that ensures deposts for customers. this is the third bank to fail in two months. there's a relief other banks haven't failed. as you can see, the medium-size

banks are struggling in the united states. there's concern that contagion may spread to other parts of the world. but so far, the authorities seem to be handling each one on a case-by-case basis. as i was aing, j.p. morningen will take over the assets, the deposits held with the bank. customer deposits are safe for now. authorities trying to get ahead of things before the markets open late today. we'll wait to see how the markets interpret all of that. we'll bring you more details through the day. so first republic has failed but its assets have been assured by jpmorgan and the authorities. meanwhile in texas, a community is in mourning and investigators asking the public for help. this man lost his wife and 9-year-old son in a shooting. killed three others. and here's what the county sheriff investigating the case had to say. >> my heart is with this

8-year-old little boy. i don't -- i don't care if he was here legally. i don't care if he was here illegally. he was in my county. five people died in my county, and that is where my heart is. >> meanwhile, more than 200 officers from law enforcement agencies are involved in the manhunt for the suspected shooter. and there's also an $80,000 reward being offered for any information that could lead to his arrest. an fbi official says they have, quote, zero leads on the suspect's whereabouts. sn's ed lavandera has the latest. >> reporter: while the hunt continues for 38-year-old francisco oropeza a man accused of shooting five people in cleveland, texas, the husband and father is detailing how the night unfolded. wilson garcia said he was at

home with a group of friends when he asked he and two other men walked over to the neighbor's home, oropeza to shop shooting the weapons so close to the property because the babies were asleep. he said they asked him to shoot the weapons. it was a intense exchange garcia said they called authorities and 911 five times prior to that. ten minutes later, that's when say they co or opeza came back. one of the woman told him to get out of the house as quickly as possible because his wife and son were already dead and they didn't want to lose him because his two other children shouldn't lose both parents. horrific details that wilson garcia is detailing of that night. in the meantime, investigators continue this man hunt.

they've been searching for francisco oropeza since friday night where he was able to flee the scene but at this point, investigators say they have no idea where he might be. >> right now. we just do not know, because if we did, we would have him in custody right now. we do not have any tips where he may be. that's why we've come up with this reward so that hopefully somebody out there can call us. i pretty much can guarantee you, he's contacted some of his friends. right now, we're just running into dead ends, right now, we have zero leads. >> reporter: in hopes of trying to get information on francisco oropeza's whereabouts, the state texas agency has thrown together money for a reward. it's 80,000 that's leads to the capture of oropeza, right now, investigators say they lost track of where he was sunday. they found his cell phone and

clothes discarded in this area. but other than that they have no idea where he might be at this point. ed lavandera, cleveland, texas. >> one possible challenge for law enforcement if oropeza manages to cross the southern border into mexico. cnn's law enforcement analyst steve moore points out because oropeza is a mexican national would complicate the arrest. >> being a mexican national, once he gets across the border if he does, they won't expedite for a capital crime. so, we would have to as a nation decide we're not going to seek a death penalty in order to get him back. so the mexican government would actually have some kind of influence on the penalty phase of our trial if they can extradite him. but right now, the fbi is probably coming up with a list of everybody he communicated with. they probably got his phone records. anybody he talks to, anybody

he's friends with, anybody who he thinks might shield him or give him aid. the fbi is probably on them right now. >> moore also says that the fbi has tried to anticipate the suspect's next moves based on the evidence that they've obtained so far. there's yet another instance of gun violence over the weekend involving american teens. this one happened early sunday morning in a base at u.s. mississippi on the gulf coast. authorities arrested 19-year-old cameron everybody rest brown for a deadly shooting at a house party. he's the only suspect in a shooting that left a 16-year-old and an 18-year-old dead and four others injured. brown is being held without bond. his first court date is scheduled for next month. a group of american citizens are about to step on dry american land. hundreds and other nationals made the trip across the red sea

to port sudan. cnn's larry madowo is live. where some of the evacuees have just arrived. the last evacuees, because the cease-fire is expected to last much longer. >> reporter: right, max, we understand from the u.s. consulate here in jeddah is about 100 americans, we're not sure but this is the largest american british ship arriving here in jeddah. jeddah here saudi arabia is the main land, part of is proximity from the red sea to jedjeddah. but it's also because of khartoum being untenable, people are fleeing, making the arduous journey, 700, 800 kilometers east and hoping to get to j jeddah.

the biggest operation is the saudi government. we took a trip from royal saudi navy they've evacuated about 200 on the ships. but the number of ships is not enough for the number of people that need to leave especially from port sudan. that's why the americans have "u.s. navy brunswick" it has about 100 americans as i mentioned but nationalities, we're seen norwegians, australians, germans, i believe there's several other countries here as well. there's 28 brits on the ship. this is a continual operation for the brits, but for the americans that arrive in port sudan over the weekend, there were two major convoys that were coordinated by the u.s. embassy which had private citizens of sudan and other nationals, and likely to be more americans looking to come here. we asked the consulate in jeddah

if there are more american ships, we cannot speak for sure. but we know there are more americans trying to get across the red sea to here in jed za. >> larry in jeddah, thank you. sudan's army and paramilitary rapid support forces have agreed to yet another cease-fire. it's the sixth once since the conflict between the two groups began two weeks ago. sudanese doctors are warning that dead bodies left in the streets are creating an environmental catastrophe. they say shortages of food, water and medicine are also putting the country at risk for humanitarian crisis. now the u.n.'s world food program has lifted the operation of in sudan after three workers were killed there. let's bring in cnn international correspondent dave mckenzie joining us live from south africa. your heart goes out to the

people left in ckhartoum, as those people get out of the country. >> reporter: max, that's right. there is a bit of good news for the humanitarian food program lifting the suspension, tragically after a few staff members were killed in the early day of this conflict. it's a cease-fire, but as we've been saying now, a cease-fire in name only. you kind of wonder why they keep naming the cease-fire when the fights continues. eyewitnesses and journalists for cnn saying the fighting has continued in several parts of khartoum and also insecurity in other parts of the country. the word coming from the sudan doctor as union that awful news that bodies are lying in the streets, presenting a health hazard as well as obviously many days of no public services, that deployed police, expanded police on to the streets of khartoum, i'm not sure what impact that will have on the fighting.

it's hard to independently verify the information coming from the sudanese forces and the rapid support services, the paramilitary group that is battling them. and you've had supported claims in the last few days in terms of the site controls and the responsibility for the atrocities happening. we do know based on eyewitnesses, though, that the situation is deteriorating, max in the capital especially with lack of food, lack of water, lack of medicines, everything really for a normal society to function is breaking down. and you have people streaming over the border in the west of the country because of insecurity from other armed militia. into chad. those refugees have harrowing stories to tell. >> okay. dave mckenzie, in johannesburg, thank you. we'll keep across all of those latest developments around the cease-fire, whether or not it holds. the deadline is looming but

♪ turning to the top story, after days, jpmorgan is buying most assets of first republic bank in a deal arranged by regulators. the federal insurance corporation announced the deal on sunday. saying jpmorgan chase will seize all of the deposits, especially all of the assets. all branches will reopen today. this makes first republic the second largest bank failure in nation's history. meantime, doomsday clock ticking for the debt ceiling crisis with republicans and

democrats. the republican-controlled house last week passed a bill to enable the u.s. to continue borrowing so it could pay its bills but it includes deep program cuts. president biden has made clear he won't approve. and with the president refusing to negotiate it's still unclear how or when there might be a breakthrough. cnn's alayna treene reports from washington. >> reporter: house speaker kevin mccarthy accomplished a major feat this week in pushing that bill through the house. but he has a much bigger challenge ahead in navigating how to avoid a default. and it doesn't look like this bill has changed the dynamics in washington here. the white house and democrats are slamming this bill as dead on arrival in the senate. they're also digging in on refusing to any cuts tied to the debt ceiling. and i believe republicans are stuck in a stalemate on how to move forward. the key question is what's next.

republicans argue it's time for president biden to come to the table and anchor out a deal. >> the white house, since this congress has began has had no ideas whatsoever except jacking up taxes and spending more money. we've got to get this right, dana. and the schumer senate, they have no ideas either. our recommendation is we pass it through the house, take it up in the senate, and pass it. >> reporter: so emmer argues the senate should take this to the house and pass it. most democrats are refusing to even consider this bill as a jumping off point for a future deal. but it is worth noting we are beginning to see cracks in that mission. emmer mentioned senator joe manchin he's one of a number of democrats pressuring joe biden to start negotiations. congress is running out of time, bottom line. and current estimates put it in sometime in july. the house isn't even in this

week, they're on recess. it's unlikely we'll see the ball moving forward in the coming days. and with the deadline right around the corner, every day counts, alayna treene, cnn, washington. the attorney for donald trump is set to continue his cross-examination of e jean carroll. carroll has accused trump of socks wally assault her in a department store dressing room in the 1990s. on the witness stand last week, she pushed back as trump's attorney questioned why carroll didn't get the attention of others in the store at the time. and about the details about her allegations. legal scomperpt experts are wein how trump's attorney is doing in court. >> i don't think it's going that well for him. i used to prosecute sex crimes. and it's a delicate balancing act that you have to confront a complainant that way. i suspect more on his style and blustery of donald trump. part of the problem for him,

he's really raising these 1940s types of negotiations that unless a rape victim fights and screams that they're basically not being sexually assaulted. he also has a little problem, he can't make up his mind, is he really trying to argue she consented which he's saying it didn't happen, versus she's making it up. arguments like you didn't scream enough or laughing, she said she laughed to try to keep trump off of her. that goes whether or not you're consenting not just making the whole thing up. >> carroll has testified she was afraid of trump at the time and worried he would retaliate. she said she only felt comfortable telling her story when other women began speaking out during the me too movement. flat governor ron desantis brushing off the lawsuit filed by disney against him. the feud gee began this week, with disney suing desantis. disney spoke out against what

critics described as desantis' so-called don't say gay law. on thursday, the governor called the lawsuit political and without merit. but this dmufeud which lasted m than a year now continues to consume desantis as he prepares for a presidential run next year. experts say disney may have a solid case. >> my guess is it's going to court and i think disney has bottomless pockets when it comes to legal, you know, fire power. of course, this is going to cost the taxpayers of florida dearly. but this is -- this is a different breed of cat here. this is a first amendment case. and as disney argues in its court filings, the government cannot punish you for speaking your mind. i think in disney keeps the focus on the first amendment issues they might be on solid legal ground because what makes this interest is there's a whole long paper trail of ron desantis making statements that appear to be retaliatory in nature against

disney. and that's a violation of disney's right to protected speech. >> you got to pick a fight with someone, or an organization this large and you're not going to win it, it belittles you, and it makes you look kind of smaller politically. it's also just distracting. this is now consuming everything. i mean, a few months ago, people were focused on his re-election success and the way he's expanded his coalition in florida. and now it's disney, disney, disney. in the event, if he's going to paint himself to be a fighter, she he's going to have a pretty big opponent down the line with president trump so this might be a test case that's making the trump people pretty happy. we could soon know whether the late of republican party may include the party's only black senate. tim scott has been testing the waters for month in terms of a

♪ welcome back to "cnn newsroom." i'm max foster. if you're just joining us, let me bring you up to date with the top stories at this hour. first republic bank has been the third major bank to fail since march. most of the banks are being purchased by jpmorgan chase and represents a further attempt to prop up banking confidence in the system. more than 200 law enforcement officers have joined the search for a man accused of killing five people in texas. authorities say they have no idea where he might be. u.s. states that border mexico are braising for a new

potential supersurge of migrants. that's because the federal government's title 42 is expiring a few days from now. that enabled the u.s. to quickly expel migrants because of the pandemic. but now the that biden administration has declared that the health emergency is over, cities on the border are anticipating a huge imflux of migrants. >> we're getting prepared now for what we call the unknown. and the unknown is what will happen after may 11th. title 42 will be lifted after may 11th. and there's a lot of -- we're starting to see pick up some momentum. as asylum seekers who are on the streets of downtown el paso and other areas of our community. >> mayor of el paso, texas, says he plans to declare a state of emergency that allows to prepare for housing needs if there is a surge.

meanwhile, the biden administration is making clear that the border will not be wide open. and regular border rules will be enforced. meanwhile, chicago's mayor is urging texas mayor greg abbott to stop what she calls inhuman main and dangerous action of bussing mightrants to her city. larry lightfoot sent a letter to abbott stating in part, your lack of coordination in an attempt to cause chaos at principal points has resulted in a critical tipping point in our ability to receive individuals and families in a safe, orderly and dignified way. we simply have no more shelter spaces or resources to accommodate an increase of individuals at this level, with little coordination or care does not pose a risk to them or others. cnn has reached out to governor abbott's office for a response. turning now to ukraine where officials say russia has launched a new round of missile and drone attacks against several regions in the east.

more than 30 people have been injured including five children. a top ukrainian commander said 15 of 18 cruise missiles fired by russia were intercepted and a ukrainian official in kyiv says the country's air defense forces destroyed russian missiles in the airspace above the capital. underground, ukrainians in kyiv took shelter in the city's metro. images show some people sleeping and others sitting on the platform while they wait the danger to pass. cnn's clare sebastian with developments joins me now. a frightening time for everybody involved particularly with the offensive coming. >> yeah, i think it shows on the russian side, while they're not making much progress on the line, they're significantly able to in air. with the forces in action, significantly fortified by the western aid that ukraine has been receiving but still not enough to stop all of those missiles from getting through. i think we're at a point where

we're seeing intensified activity really on both sides. these predawn barrage from russia on monday comes of after a huge attack on friday, one of the deadliest of civilians in months. we're also seeing explosion information the last week deep behind russian lines, and there is a fuel depot in crimea where ukrainian forces described as god's punishment. that could be the beginning of a counteroffensive. ukraine is saying they're completing operations for the counteroffensive. we know from satellite image that cnn has reviewed that russian defense significantly on the southern front lines have significantly increased hundreds of miles of ditches and trenches and mine fields and things like that. so it seems that momentum is stepping up against this ukrainian counteroffensive. we don't know when and we think it may number the south. but this seems to be a pivotal

moment. >> clare, thank you very much. kevin mccarthy is in jerusalem overseas as speaker of the house. in a few hours he's scheduled to deliver a speech to the parliamentary knesset. it comes at prime minister is facing angry backlash over his judicial overhaul plans but benjamin netanyahu insists his plan will not weaken israel's democracy. tens of thousands of people have been protesting against the proposed overhaul since january. they say it would weaken the supreme court by giving parliament the right to override with a simple majority. in an interview with cnn's fareed zakaria indicates they may be backing away from that controversial aspect. here's more of what he had to say. >> one thing i guarantee you at the end of the this process, israel was a democracy, say democracy will remain a robust democracy. and you see that by the fact

that hundreds of thousands of people are demonstrating for and against this judicial reform in peaceful demonstrations in ways that are not possible within an enormous radius. and when you have that, as you have in france or protests in france, or protests in the united states, it's not a sign of the collapse of democracy. it's a sign of the robustness of the public debate which i'm sure, and i hope and i'm working to resolve, by as broad a consensus as i can. workers across france are expected to mark this may day with protests against the pension reforms. labor unions are calling for mass demonstrations against the new law that raises the retirement age to 64. cnn's paris correspondent melissa bell reports. >> reporter: a winter of discontent in france. what began on january 19th with more than 1 million people in the streets, public and private sectors, brought to a standstill

has dragged on. one poll suggesting that after months of marches, 62% of the french are still opposed to raising the retirement age from 62 to 64. it was the government's decision to force the reform through parliament by passing a second vote that sparked fury in the streets with hundreds of police officers injured and hundreds of protesters detained in one single bloody day and night. amid accusations, the government was ignoring the will of the people, weekly clashes between police and pockets of protesters became the norm. with the union's dominating the streets, marches have been mostly peaceful. although comparisons have been drawn with the yellow vest movement whose anger consumed france for more than a year. a volunteer medic has tended to protesters through years of protest dealing with blunt force

trauma, burns and consequences of tear gas. he spoke to cnn london under an assumed name for fear of retribution. >> maybe less tear gas, because the police and government know the majority of the population, so it's still very valiant. >> reporter: that anger in the streets goes beyond just pension reform as the french vent their fury of president emmanuel macron's bullish approach to governing. >> we live a very french moment. democracy is not only okay, each five years, or each four years i vote and that's it -- no. the democracy on the streets is back again on the debate. prosecute retention reform is finally law but protesters are still making themselves heard. >> translator: it's not the pots and pans that will move france forward.
