breaking tonight, there is word that new york jets quarterback aaron rodgers could be in the running for the vise presidency. he's reportedly on the shortlist for robert f kennedy junior and rfk junior joins us live with answers about that in minutes. but first, dismissed. several key charges in the election interfere his case against former president donald trump have been dropped and the fulton county da pursuing the case might also be on her way out. for senior national correspondent kevin cork is live in dc with wear the case goes from here. >> reporter: good evening trace. the charges dropped against the former president, notably involving what prosecutors have deemed a pressure campaign on georgia secretary of state. including the infamous call in which mr trump asked him to "find enough votes." exactly 11,779 to overturn joe biden's apparent victory in the state. the judge ruled that as written,

the six counts contain all the essential elements of the crimes but failed to allege sufficient detail regarding the nature of their commission. the ruling according to the trump team is a correct application of the law as the prosecution failed to make specific allegations of any alleged wrongdoing on those counts. the entire prosecution of president trump's political constituents -- i could say constitutes political election interference and should be dismissed. it is important to note that the judge's ruling does not, repeat does not impact the charge that each defendant faces nor is mcafee's ruling linked to the judges examination of fulton county da relationship with the special prosecutor on the case which he is also expected to rule on this week, perhaps as soon as friday. to recap, the former president had three of 13 charges against

him dropped. former white house chief of staff also making news today. he had one of two charges against him dismissed for setting up the call from trump and rudy giuliani of course also on the president's legal team had two of 13 charges against him dropped as well. keep an eye on what the judge decides to do in regards to fani willis. we could know that tomorrow or at the latest probably friday. we will keep you posted. >> trace: thank you for that. that's bring in former deputy assistant attorney general and kalb berkeley law professor. glad to have you. this appears to be very bad news for fulton county da fani willis and her team of prosecutors. >> this underscores how illegitimate some of these prosecutions being brought against president trump, particularly by the da in new york and now the da in fulton county really are. look how this judge said they had to stretch the law in order

to create charges. had never been brought before not just against a past president but someone who is one of the major party candidates for our office. this really brings a lot of the other stretches of the law that fani willis is bringing into doubt, like her claim that the entire presidential reelection campaign is some kind of organized crime organization. >> trace: yeah, jonathan turley said this today. >> these counts could be essentially revived if they want to go back to the grand jury, but that will eat up calendar space. it may make it difficult to try the case before the election. >> trace: i wonder if you think this is a case of prosecutorial inexperience. we know nathan way does not have experience and they just kind of let this stuff fall through the cracks. >> this really puts this judge on the hot seat in terms of the conflict of interest claim that fani willis is facing with

regard to hiring her boyfriend for $600,000 who had never tried a criminal case and now you see the judge saying this is second rate shoddy work. this almost never happens were a judge tosses out the charges even before the trial has started. it really shows that fani willis really was playing around fast and loose with the rules with this prosecution. >> trace: and it kind of goes to your point, the wall street journal said the high price of democrats anti-trump law fair, but the american left and never knows when to stop so it's waging they get trump legal assault on every imaginable front. at least half the country is coming to believe that the legal system is being swallowed by rank political partisanship. worth it? i mean it really is kind of giving justice a black eye here. >> it's sadly true. look, i agree, the one key prosecution is the january 6th prosecution that's going on with the special council. all these other ones are adding

on, the da down and fulton county, down in manhattan, they are just piling on trying to make political points and to do that they had to really stretch the law into unprecedented territory and the judges here aren't having it. >> trace: ten seconds left, does fani willis stay, does she go? >> in the best interests of her office and for georgia she should step down and let another prosecutor take a look at this. i could see another prosecutor saying this is not worth it, let the special council handle this in washington, states should not be going after former presidents >> trace: great to see you as always, thank you's are. the economy and immigration remain two of the biggest issues for voters even in the key swing state of arizona. brand-new fox news polling shows more than half of voters consider both extremely important with that let's bring it tonight's political panel, attorney along with political washington reporter. thank you both are coming on.

i want to put this up if i can on the screen because this is arizona favoring biden. these are the groups, this is the fox news poll that we want to look at this because this is where it shows favoring biden but it also shows where donald trump sits and look at hispanic voters and women if you would because you can see there is an improvement. women for the former president 46% and hispanics at 43%. that is closing a gap for the democrats and has to be concerning for joe biden. what do you think? >> i agree with you. that gap is going to continue to get closer and closer because the economy matters to many immigrants and women and you are continuing to see joe biden's disaster. not only do we have runaway inflation, costs of goods have risen, people are unable to buy and sell their homes. now biden has failed because he has put out a $7.3 trillion budget, an insane level of spending so as we can't afford

today, how are we going to afford tomorrow? that's what we care about the most so i'm going to continue to see this gap closer and closer for trump and he's going to dominate in the swing states. >> talking about what you can it cannot afford. in pennsylvania that was a big issue for voters there because trump is leading a little bit in pennsylvania but it really is neck and neck and within the margin of error but you look at the family financial situation and four in ten, look at this, are you getting ahead? fourteen%. holding steady? falling behind? 86% of this, people either holding on by tooth-and-nail or falling behind. >> yeah, these numbers have the white house in it not speak as they can't figure it out because they feel like the economy is doing well. in pennsylvania i would add to that one issue they have faced is a new ban on new exports --

new export projects of liquefied natural gas and pennsylvania is a huge state for the shale and natural gas and that is unpopular, that band that the biden administration did, and even the democratic senators have said they are not with biden on that. >> trace: this is a five way race. let's start with pennsylvania. you see joe biden at 42, donald trump 42, robert f kennedy junior at nine. i bring this up because robert f kennedy junior will join us in a few minutes here. i want to move ahead now to arizona, the five way race, joe biden at 39, donald trump at 43 and robert f kennedy at ten. you can see there's a pretty good number -- those are pretty good numbers for the third-place candidate and you can see why a lot of political analysts are saying, you know, this could be instrumental in how this presidential race comes out, the robert f kennedy candidacy. >> you know, these third candidates have always come out of the woodwork.

they are not really going to make an impact because right now we know that president trump has the strongest record not only on the economy but immigration. when you look at arizona, it's devastating, the number of illegal immigrants without any type of measure to secure that border. so while we have this third party candidate, it's going to continue to narrow that margin. trump is going to continue to dominate and i think this is in effect, i think he has an interesting platform but it won't be enough to destroy what the gop candidate has and he's leading right now. >> trace: when you are telling -- pulling 10 percent you are pulling it from somebody and both candidates should be concerned because it's going somewhere. now dan, you wrote this, biden's advanced team is rife with turmoil and toxicity the staff allege, going on to say that the biden office has earned such a bad reputation that some seasoned veterans had to -- declined to pitch and when asked those familiar with the biden

operation said that meant more room for error, especially as the president travels more frequently ahead of the general election. how bad is it? >> well we talked to 18 people who have experience with this office, either worked there, and they described a pretty bleak situation. they pointed the finger at one top person who just left, they said that he was parading junior staffers regularly, calling them pieces of expletive. calling them worthless, saying he would ruin their lives. so he denied some of that stuff but he resigned on march 1st after a white house council investigation where a bunch of people were interviewed. >> trace: sounds like a mess. thank you both. as we just showed you, a third party candidate could be the biggest deciding factor in the presidential election. very big news for robert f kennedy junior and we will ask him about that when he joins us live on set in just minutes.

we will also ask him about the quarterback, aaron rodgers making his shortlist for vice president, coming up just minutes from now. as illegal immigration remains a top issue for voters, our cameras were rolling today in eagle pass, texas as the flood across the border continues and the fbi is now confirming the number of got a ways slipping into the country day after day remains a huge national security risk. matt is live with the latest. >> reporter: for years now fox has brought you video from the southern border showing the millions of migrants who arrive on american soil and surrender. those millions of migrants alone are a crisis but what that video does not show you is even more concerning. the illegal migrants who do not turn themselves in and sneak into the united states. there's been more than 1.8 million got always since president biden took office. right now this border is averaging about 800 per week. fox news obtained this nighttime video from texas showing dps

troopers arresting a suspected human stroke -- smuggler after he used a raft to drop off illegal migrants, got aways, here in the united states. this new body camera video shows that texas tracked down three illegal migrants on a private ranch. texas state troopers say they arrested a member of the mexican cartel trying to hide in camouflage clothing. two other illegal migrants were busted in the recent arrest. in the laredo sector this weekend border control and texas dps busted this stash shows were more than 300 people were hiding out after crossing the border illegally. stash houses are properties used to hide the got aways until their next move in the united states. and new texas law will allow police to arrest migrants who illegally cross into the united states. it was supposed to go into effect march 4th but the supreme court has put that law on hold while they decide whether or not to let it go

forward. also playing out tonight across the country, 26 attorney general's cross the u.s. signed a letter urging senate leadership to pass the laken riley act which would detain illegal migrants for some criminal offenses until they can be deported. >> trace: still a big subject, matt, thank you. let's bring in boston resident and radio talkshow host, grace it's great to have you. i want to begin where matt left off because there was a great op-ed in the near post that reads as follows, is laken riley's life worth less than george floyd's? lloyd's death ignited nationwide protest to reform police procedures. fast-forward to february 22nd, 2024 when georgia nursing student laken riley was bludgeoned to death allegedly at the hands of an illegal migrant. the democratic mayor of athens, georgia where she was killed insists the focus should be on the individual perpetrator, not migrants as a whole. ridiculous.

was the focus only on derek chauvin, the cop with his knee on floyd's neck? so they changed the dynamic of safety and, you know, the law in this country in policing and so forth and now they are saying republicans are trying to take advantage of this. the argument just does not make sense. your thoughts? >> i agree with you there. the left has never been opposed to using an individuals tragedy or an individual's story or circumstance to shape policy, to inform policy and this is a new philosophy, a big change up. something similar lately where we should not let one person's situation, at amparo fries -- paraphrasing, shape policy. but here's the other part i have an issue with, this is not a one-off circumstance. unfortunately we are seeing these tragedies all the time. i mean i would encourage people to check out bill from fox's twitter. it's hard to keep up with all the things that are happening

because of our open border and so not only is it ridiculous to now claim we don't let, you know, certain tragedy shape policy if they don't fit our narrative, but beyond that is not just one time. you have molly, kate, there are so many circumstances, so many atrocities that can't be ignored >> trace: you were talking about kate, of course that happened in california. i will get to boston in a moment but i want to pose this to you. what do you think of california now offering these loans to illegal immigrants? we are talking about 20 percent down payments, $150,000 and there's no interest and you don't have to make any payments until the house is sold. what is the message that we are sending to people around the world that they will give you rent and food and cell phones and legal aid and you name it and then they will help you buy a house? >> welders two messages that are being sent not only to people around the world, which is

obviously incentivizing people to come here, a kind of goes back to what joe biden said when he was on the debate stage, i'm going to tell people to surge the border. that's another way to tell people to do just that. and i think it's important to note, the message we are sending to americans, that you come last and if people coming here and they break the law, they are going to get more than you, they are going to get better treatment than you and i think that is going to be a real problem for joe biden heading into this election. >> trace: lastly we've got local 12 in boston saying massachusetts will spend 10 million to help migrants get permanent housing and jobs. of got about 30 seconds but it seems like, you know, it's a big voting issue across the country for a reason because it's affecting everybody, this immigration crisis. >> yeah and i think people are really sick of this quick payment from the biden a ministration. they went from the border is secure, there's nothing wrong and then very quickly to well there is a problem but it's not our fault and i don't think anyone is buying that. not in boston and in all of

these big cities across the country. >> trace: great to have you on the show, thank you. meantime the house of representatives passed legislation today requiring the owners of the tiktok social media app to cut ties with china or get banned in this country. ashley live with reaction and what happens next. >> reporter: congressional lawmakers are one step closer to taking down tiktok and that's nationwide. the ban on the chinese own social media site easily passed the house 352-65, getting overwhelmingly support from both democrats and republicans. it does advance to the senate where it's prospects aren't clear, especially after president trump seemingly reversed course on his support for that man. while he still believes tiktok could pose a risk to national security, he also said banding it would cause a public outcry. listen. >> frankly there are a lot of people on tiktok that love it, there are a lot of young kids on

tiktok who will go crazy without it. >> so president biden who has indicated he will sign the ban if it makes it to his desk and still uses the platform for his campaigns, and president trump now find themselves on different sides of an issue that could be an opportunity for trump to make up some young voters. according to a new research center that is nearly one third of adults ages 18 to 29 regularly get news on tiktok compared to only 15 percent of those ages 30-49 and then 7 percent of those 50-64. some users, including small business owners and influencers, to send it on the nation's capital to speak out against the ban. >> it's disappointing to see that it passed in the house but it's encouraging to see that in the short amount of time that we are making our voices heard it went from 12 nose to 67 so the longer time goes, the more they

>> this election will be a near run thing. it will come down to a few states, a couple hundred thousand voters so any third party candidate especially with a last name like kennedy poses a challenge. >> said the following, trump and biden should be terrified of a third party candidate. you are clearly making an impact. what are your thoughts on this? >> well my thoughts are that the american public wants another choice. eighty% of americans say they do not want a rematch of 2020. people say that they are tired of being presented with a choice between the lesser of two evils. they want a candidate who they believe in, who gives them a hopeful vision for the future of this country, who is caring about ending the wars, ending the chronic disease epidemic in the middle class and making sure to protect our constitutional rights.

i think we need another voice. we should not just be forced to choose between two bad choices. >> trace: it's interesting because people are asking me all the time, what has to happen for robert f kennedy junior to make an impact, to be squarely in the running in november. you got seven months, seven plus months. >> yeah i mean i think our first challenge is to get on the ballot in all states and we will do that. i think we will be on the ballot in most states within probably six or eight weeks. and we will be on the ballot in all of the states that we can legally get on in that time. some of the states open later so you can't start gathering signatures but as those states come up, we will get on those ballots. here in california, we started our own political party. people have to go to kennedy

24.com/california and register for that party. we need 75,000 registrants and then i'm on the ballot here. >> trace: you go forward and there's -- you started your own party, there's been talk of no labels, talk of other things moving on there. would you move if you had more support, if you had more money, if you had something that was going to steamroll you, would you consider moving? >> moving? >> trace: to another party or another platform. would you become the vice president of the united states of donald trump ask you? >> know i would not. my marriage would not survive that. but we will get on the ballot. i'm not worried about getting on the ballot. i'm now beating both president trump and president biden among americans under 45 years old. and beating them and independent voters which now is the biggest political party. this is the first time in american history and independent -- independence have outnumbered

democrats and republicans. only 27% are democrats, 27% republicans and i'm beating both president trump and president biden in that is cohort. >> trace: you have said clearly that you will not run if president trump, former president trump, ask you to be his nominee, his vise presidential nominee. it's a no, it would hurt your marriage. meantime you've made your choice on who you are running mate will be and we know that aaron rodgers, the quarterback for the new york jets, formerly the green bay packers, is a prominent name in that. why? >> you know, he's one of the people we've talked to. i really like him because, you know, our appeal is to young people. we are trying to make sure that young people are participating in the political process, that they have hope for america. we want somebody, the people who have run up that debt on that generation are all older people and we want somebody young who's

going to look out for that generation. aaron rodgers is battle tested, he's stood up and been hammered by the press. stood up for things he believed in and i like that part of his character. he's a critical thinker and i think we need that as the rise of ai, we need people who understand that you cannot always trust authority, just because somebody is in charge it does not mean that they are telling you the truth. we want somebody who is going to critically examine. my father used to say one of the duties of living as a citizen in a democracy is to maintain a constant posture of skepticism toward authority and i think he has shown that. he's also somebody who i think will help me get the country healthy again. he's 40 years old, he's focused on his own health, he's very aware of health issues and that's one of the things, one of

>> trace: the "fox news @ night" commonsense department understands that california lawmakers have formed a happiness committee. that's a committee to make residents happy. he comes on the heels of a new study in california that shows only 16 percent of residents are happy. so far the happiness committee is kind of off to a slow start and has yet to come up with any ideas so commonsense would like to offer a few suggestions like reining in the astounding rules and regulations required to build a home, which in turn might lower the cost of building a home and the cost of buying a home because right now the average home in california is seven times higher than the average home nationally. in california you pay more for everything, food, energy, taxes, even insurance. cartoonist once said happiness is a warm puppy, until he got his california vet bill which is twice the national average. commonsense thanks cutting crime would make people happy.

it's a sad one fast food restaurants are all drive-through because they get robbed every time they open the doors. in and out burger should now be called around the side burger because you can no longer go in and out. high crime, high taxes, recipe for sadness. commonsense reminds us that aristotle said happiness depends upon ourselves. in california it depends upon a committee. school enrollment down, absenteeism is up along with instances of juvenile crime. would there be a connection. let's bring in former san bernardino sheriff's deputy and former education department press secretary. thank you for being in. this is great stuff. in oakland, we just talked about this, in oakland they have literally shut down all the taco bells, you can't go inside, it's just drive-through. in and out the same thing, other restaurant shutting down because every time they open the doors people get robbed. here are some locals in oakland

that said this. watch. >> they just pull up out of nowhere and it's not like it's only the store. they rob everywhere. it's not how it used to be. there's a lot of crime now. >> it's sad it got to the point where they can't allow people inside because they get robbed. >> trace: i mean we are a state you could not eat inside because of covid and now you can't because of crime? this is untenable. what are your thoughts? >> it really is. i hate to say we told you so but we knew defunding the police was never going to work. and then you bring in progressive das that refused to hold criminals accountable and it's a recipe for disaster. i never imagined that you would not be able to sit down in a restaurant, it a meal with your family and worry about your car being burglarized. i think like you said, you know, california is really going down a bad path and we wonder why people are so unhappy here. >> trace: exactly right, it goes back to the happiness committee. virtual -- former education wrote about the drop of

education in public schools. enrollment drops and chronic absenteeism tell the dramatic tail. the proportion of students attending schools that on high or extreme rates of chronic absenteeism more than doubled from 26% during the 2017/2018 school year to 66% during the 2021/22 school year. and you read these new studies that kind of say the more kids are absent, funny how crime starts going up. there has to be a connection somewhere. >> there is and it's as awful as it is predictable because there are really two forces at play when we talk about chronic absenteeism. the first is that four years ago , actually next week, teacher union starting telling americans that school wasn't essential, that you don't need to show up, we will just keep those schools closed indefinitely. and they were wrong but some people unfortunately believed that. and the second is there are so many failing public schools and this is not lost on parents and students. they know if your school is not

going to teach you to read, right and do math, why bother showing up. so the fix is a school choice. give people access to schools where they want to be and that's how you get students back in the classroom. >> trace: you talk about one of the top universities in the state, pair prince are hiring security to protect their kids. here's what one student says, personally i don't feel very safe on campus and i just always have to be aware of my surroundings. that is something that is always in the back of my mind. i mean it really is. a top university, when you have to hire security to keep your kids safe, you know that something is going wrong. we've done something wrong. >> exactly. i mean i was a school resource officer for six elementary schools and those kids thrived. they love seeing police on campus so why do our young adults not deserve the same protection. if we are able to get our police officers into our schools, protect the students to their best ability, we will see the rates dropped, it's will go to

school because they feel safe and we will see the literacy rates excel because they are going to school for a purpose. >> trace: and speaking of a purpose and now upper education, you talk about university of texas, they are now tree implementing the sat as part of the admission program because they said "the university has also demonstrated that knowledge of standardized test scores contributes to higher graduation rates. the kids that don't submit sats are not doing as well in college. your final word? >> well this is that rare glimmer of good news in the education world today because the entire push to move away from standardized testing was rooted in that harmful equity ideology. but these tests allow admissions officers to truly compare apples to apples. and as it turns out, mayor it matters, ability matters so it's great to see more and more schools returning to looking at these test scores. >> trace: thank you both.

speaking of college, one of college football's most successful coaches says the game he dominated for years no longer exists. he was on capitol hill speaking about new rules that allow players to be paid and how that has changed the sport. here's the senior congressional correspondent. >> reporter: he won seven national football titles but he's no match for major changes in college sports. >> all the things that i believed in for all of these years got 50 years of coaching, no longer exist in college athletics. >> reporter: paying student athletes for their name, likeness and image. >> i believe it will destroy the student athlete as we have known it. >> reporter: a court ruled the ncaa can't restrict and il inducements for players to sign with certain schools. that creates a form of college free agency and is why the ncaa implores congress to legislate guardrails. >> there's agreement that congress needs to act.

to ensure that we have a level playing field. >> reporter: but and il advocates are skeptical. >> i think the hands-off approach is the right move. >> reporter: so student athletes are acting on their own. the dartmouth men's basketball team just unionized, appalling conservatives. >> this is ridiculous and will expose institutions to massive tonight -- liabilities and higher costs. >> reporter: but pro- labor members are supportive. >> they are trying to ensure they can advocate for safer playing conditions. >> reporter: however classifying student athletes as employees raises other questions >> what if the school did not agree to demands and then union cultist on strike? and employer is not required to pay employees on strike. can i still go to class? >> reporter: nick says student athletes have changed, threatening to transfer if they don't score enough playing time. >> all they care about is how much i pay them, not how you will develop them. >> reporter: schools as they could pay football and basketball players but at a cost , eliminating other sports.
