though martha, did the biden demonstration improperly colluded the allegation with of the social media companies to take down some of the posts? we are talking about the largest tech firms in the country to moderate or fight digital disinformation, content posted by private parties. everyday people on twitter carrick facebook, other big sites, the biden administration accused and sued for collaborating these large companies to take down some of these vaccine -related posts. hears a sceptical justice questioning the government. >> the only reason why this is taking place is because the federal government has got section 230 and antitrust in its pocket and to mix my metaphors and it's got this big clubs available to it. it is trading facebook and these other platforms like their subordinates. >> a big day in the -- justices

will render a decision by the end of june, early july at the latest martha. >> martha: thank you david very much. joining me now as former federal prosecutor and current attorney could to have you. i want to get into wants going on with the supreme court but first he reaction to this news from the trump team that he cannot come up with the 430 plus million dollars. ethic it's the largest settlement ever against an individual in this country? >> i wouldn't count him out yet. he has a week to actually have the money secured in order to file the appeal. he is now seeking the courts approval to effectively take you the $100 million in bond or to forgive the bond entirely at this point to allow the appeal to proceed. that is the next step khaki wants to appeal this. but even if the court doesn't allow it and james actually tries to foreclose on some of his properties, at thank he still has pouts to move forward through federal court ultimately supreme court to complain about 8 them in violations.

as opposed to being held in cash. i think these are unique circumstances and i hope the new york court of appeals looks at it appropriately. but like i said i think even the supreme court would have interest in the case from the eighth amendment ground. >> martha: and her quick thoughts of what happened today the supreme court and what we hear from the justices? how does this feel based on what we got? >> the biden administration continues to promote the idea that they are allowed to pressure these platforms to platform individuals and they say they can go so far as to do that unless they coerce these private companies. acting that is is a rough day for the first amendment. >> martha: and quickly guys but this facebook e-mail up from july 14th 2021 released by the house judiciary this is during the pandemic. can someone remind me why we are removing rather than demoting labelling claims that covid-19 is man-made before may? meta- employee because we are under pressure from the administration to do more and it was part of the more package.

believe we are under an invasion and the constitution specifically allows states to protect themselves against an invasion. for instance take from 2011 until 2024 pack a 13 year period only in texas, there's been almost a half million criminal aliens arrested and convicted of 187,000 crimes. murder, great, arson, kidnapping. these are felonies. so i think texas has an inherent right and duty to put their citizens. i do hope the supreme court sees it the way we due. >> this is a piece of the interview nbc did with lincoln reilly's father and they asked if the immigration policy may have made a difference in what happened to her -- lake and riley. watch this. >> to thank a difference in immigration policy would have made a difference for laken?

transcript of it and there is reference to the bloodbath when he talks about chinese electric vehicles being made in china or made in mexico and imported into the u.s. that's the context. it gets dropped out. there are other things he says that the media could have gone after he refers to the people in jail over a generous 6 as hostages. people who beat up the police he says in a completely different context not sure that if he doesn't get elected he will ever have another election in the country. those are legitimate things to ask him about but instead they picked the thing in a speech that sounds if you take the word bloodbath out of context makes it sound terrible and is talking specifically about what will happen to the american manufacturing and the auto industry specifically if he doesn't get elected. so, over-the-top and as a result undermines the competence of the american public and media. >> how we what's your take? >> this bloodbath coverage is an outrage and tally rushed out of context.

as he showed he is talking about chops before and after. there be another times where he is signalled possible violence but this is not 1 of them. interestingly enough in my interview with him i asked him about using words like vermin and poisoning of the blood and why he does that when describing illegal migrants and he acknowledged to me he does that over-the-top language and inflammatory language in order to drive media coverage. that's quite an admission given the echoes of nazi germany but he said he does it because he wants people on his turf to be his issues and if you use put ugly clark does correctly witch it doesn't resonate. >> martha: and your reaction? >> i spent 3 hours this morning doing nothing but the story of bloodbath and how his interview because the former president people want to talk about. it's been generous calling it over-the-top and it's allotted to suggest the president was calling for physical violence. he wasn't. and glad you played both the

>> your thoughts how he? >> i sense he might be open to some kind of a cease-fire because he's using fake news a lot less and almost went all the way but then said they're not doing a properly so there is no cease-fire as of now. you know, a quick thought on the coverage of this interview of mar de lago. for example i got the former president to say vladimir putin is named he is never even mentioned probably was responsible. here's some of the headlines. trump couldn't bring himself to condemn russia president vladimir putin. trump delivers a head spinning awkward answer to new question about russia president vladimir putin. he did say i don't know. he can't prove it, our camper but well know it's true. this wouldn't have happened without russia president vladimir putin being notified. but it shows you that a lot of people bring their anti- trump biased to the table or trump bias when it comes to these interviews. i try to be straight down the middle and give him a chance to say what he wanted to say.

>> martha: absolutely. it was very interesting interview. carl another thing that came up but i thought was interesting was he was asked about nikki haley and said, you know, she has some talent. everybody is wondering about the bp picks for all the candidates who are still in the running here. where do you think that whole story is going? >> i find it hard to believe that he's going to be as big and strong minded as ronald reagan was and pick his opponent as his running mate. but it was a good remark for him to make and frankly he should have made it the night he petered in south carolina. when he was in iowa he is humbled and gracious and come from entry of his opponents. we didn't and see it in new hampshire for certain. the moment he began united the party was in south carolina he should have said earlier. >> martha: hewitt you put out a short list of people you think our potential bp. what did you think about the comment? and a significance? >> i don't think he would pick

nikki haley that got a little to rot at the end. i think carl is right we haven't got the same 1 that we had in 1980. someone not designed to pick up on ethnicity or particular demographic but someone designed to attack every day about the border and about crime and inflation. i'm looking for someone who can stay on more than a thing else. >> a quick 30 seconds on the biden story about his rants in the west bank. what did you make of that? >> i think he is frustrated by his campaign and abysmally low polling numbers and the fact that trump seems to be beating him. 8 l'anse is a long time to go on all that. and anxious about his reelection campaign as he faces a rematch with former president donald trump. that came from nbc news and reports the president was seething at a private white house meeting in january, allies of the president had just told him his poll numbers in this -- michigan and georgia dropped over his handling of the war between israel and hamas. he narrowly won battleground states from 4 years ago and can't afford any backsliding if he will once again defeat donald trump. he began to shout and swear said the report. a lawmaker familiar with the meeting said he believed all this he believed he had done what's right biden had. he means with regard to the israel and hamas situation. it also points president biden's approval rating is now currently lowered at this point in his term then the last 3 presidents who lost their reelection ids.

immigration and inflation. and concerned people we'll be using the poles to try to push the israel policy because it does look lately like more politics or being involved in the policy as he really took a strong position for israel. you see it slowly dissipating here. and of course it looks like it's traced to that meeting which would be vary unfortunate because let's face it, the hundred thousand noncommitted voters, it's not the cause of his declining numbers. it's because of inflation and immigration and major issues he has to fortify with swing voters about the presidency he is doing. so i think this could be a serious misdirection here. >> martha: clay let's have a look at the soundbite from well-known cnn political analyst harry antin who watches the numbers closely as well. watch this... >> simple math at this point. biden is behind in arizona and nevada and georgia. he is behind a michigan.

ballgame over most likely, tomo trump wins. >> martha: your thoughts on all of this? >> sounds like biden is setting up for a bloodbath martha i don't know how he's going to recover from this. in all seriousness, to me and obviously mark is far more skilled in analysing these numbers than i am right now this race boils down to this. people have not change their mind about donald trump. they knew what they thought of him since 2015, they made their determination on what they thought of his presidency, but if you go to 2020 biden had 2 advantages. 1 was covid-19 witch trunk upland for fair or foul. i think it was filed because didn't cause it clearly. 2 was people were able to buy into this avuncular load -- likable grandpa joe character who promised he would restore normalcy to the white house be unthreatening at a lot of midwestern voters in particular but also in georgia and arizona

willing to take that chance. now, they have had basically 4 years of joe biden. they see him as physically and mentally unfit for the white house, they see inflation having search, war in the middle east and in europe, crime figures skyrocketing. the border is a complete disaster and they look around and say wait a minute none of this was as bad under donald trump. they haven't really changed their opinion about what they think about his personality or about his overall persona, but they have changed in a big way for joe biden. i thank the wall street journal poll, biden went from plus 10 a farmer correctly in 2020, 2 minus 11 right now purely on do you like this guy? i think that is the election. i think that's why we will spend billions of dollars and nothing we'll not really change unless he gets more likable. >> martha: let's take a look at this. this is the team who helped bill clinton when talking about what

that's an uneasy situation we try to go at sleep -- to sleep in it for these people. >> credit card rates are 20 or 21% annualized so you have to do everything in your power to reduce you're personal spending buy at least 20%. you can do that because most of us buy stuff we don't need. i always start at someone's closet looking at humming sneakers and t-shirts and jeans. when you actually look at what you are its 3 teachers, 2 jeans, 2 sneaker sets. everybody has so much of that stuff that they don't need that it should have gone to credit card debt. the key to this and the reason there is financial stress is basically 0 to 5 and a half% terminal rate at 18 months which is unprecedented in raising rates but they've stabilized now. but this is the new normal and you've got to find a way to pay down credit card debt. it's the number 1 anchor on your life because of the high rates.

the reason i owned all the credit card stocks as if you're willing to pay that much, you're paying the. don't pay me. stopped at figure out a way to pay that down. that is key. >> and really you shouldn't, you should only put on your card wake and pay that month. >> arrived to tell you i do the simple metric looking at your sources of income over 90 days on a piece of paper. every hustle you got to make money including your job, side housel even if your waitress or dork dasher doesn't matter. over 2 thirds that do this simple test including wealthy people burn more cash than they bring in. maybe you can sustain at longer if you're vary wealthy but you can't sustain it if you are basically making the average american salary, $59,000 a year. you're putting it all on your credit card you've got to stop. >> martha: you say there are certain parts of the country that are very much experiencing the american dream. it's become more state-by-state than ever maybe.

>> yes, i think you have to look at the governor of each state setting the tone. they are important but the governors of the state set the policy of. the states i'm doing business and now, montana, oklahoma, north dakota, west virginia, they have very stable policy that we used to fly over them and didn't do anything they're. i'm closing all kinds of deals right now in north dakota with remarkable companies i've never even seen before. really strong work ethic, really focusing on building businesses outside of the state and by doing this i bring in other capital from outside as well. and tell the story. these men care about the state. >> martha: their former businessmen as well who understand how to run a business and how to keep your expenses in line. speaking of that, you talked about putting together a group to buy tiktok. to have an update?

>> a bone is interested it's a delicate situation because it won't be real until the bill is passed. there is the brand and the 170 million users of which there are 5 million american businesses spending $9 billion in trying to acquire customers. that attacks me a lot. >> martha: you said it's the number 1 advertising based in the world. >> 1 of the largest networks in the world. the problem is the chinese are not going to sell the algorithm with the history of these people can't their preferences or any data about them. when people talk about it being a hundred billion dollar transaction no chance. if they're not selling the algorithm i have to rebuild it from scratch its not an expensive. at the gets more in the $40 billion range if it's a fire sale without the algorithm. but not of it happens until the senate votes. >> martha: thank you kevin o'leary, wonderful to have you with us today. could deceive. coming up, the final stretch of a republican senate primary race in ohio.
