game sunday against the dallas cowboys will hear from fans getting ready to cheer on their team this weekend. thanks for joining us for kron. 4 news at 8. >> i'm ken wayne and i'm ella sogomonian. the fallout continues in oakland as the chief of police. he's put on administrative leave tomorrow. mayor shane tower is set to address a scathing report which claims the internal affairs division is not including some police misconduct in reports under the chiefs tonight, a city council member tells kron four's haaziq mod-yoon. it's time to stop opd from investigating its own officers. >> so once again, i'm not necessarily talking about this case, but in terms of internal affairs being taken out of the oakland police department, that's one that is really critical. oakland police chief leronne armstrong has been placed on administrative leave after information in this negotiated settlement agreement. court document revealed that opd internal affairs division failed to include a policy violation involving a hit and run allegedly by a police sergeant

back in 2021, according to the court documents, the internal affairs lieutenant wanted to include that information in the the report of investigation. but as it states here on page 5, the captain requested revisions to the our ally, which the investigator disagreed and to which the investigator objective. >> nevertheless, the captain directed the investigator to revise the our ally and the investigator did so at the captives direction. oakland city councilmember carroll fife says the incident underscores the need to implement the 2021 council directive to ship police misconduct investigations away from opd to the city's community. police review agency. >> and i think part of the way that you build trust is to not have an entity investigate themselves when there are allegations of misconduct. >> oakland mayoral candidate, loren taylor agrees, but he says he's not exactly in favor of placing the chief on

administrative leave in this case. clearly the head of the department. >> on dmadministrativivleave is a signal from leadership they are, you know. seriously exploring a other options. i think that is it undermines confidence and consistency in the what has been built and the strong momentum of community geengagement there sing tao released a statement about putting the chief on admin leave, reading in part, quote. >> the decision was not taken lightly, but we believe that it is critical for the safety of our community that we build trust and confidence between the department and the pupupuli >> we must have transparency and accountability to move forward as a safer and stronger oakland, unquote. has it made kron 4 news? >> and this disciplinary action involving oakland police chief armstrong is just the latest chapter in a long, complicated history for opd.

coming up in about a half hour. we'll have a live conversation with former oakland police chief anne kirkpatrick to hear her take. she was fired after 3 years on the job following a vote by the oakland police commission, then sued the city of oakland and that ended in a million dollar settlement. other news tonight, twitter and tesla ceo elon musk testified in a san francisco courtroom today where he's facing a class action lawsuit alleging that he misled investors. >> musk was called to defend a 2018 tweet claiming he had lined up the financing to take tesla private in a deal that never came close to happening. the nine-person jury assemble this week will be responsible for deciding whether or not those tweets damage tesla's shareholders. the tweet has already resulted in a 40 million dollar settlement with securities regulators. learning that the theranos founder, elizabeth holmes reportedly tried to flee the u.s. after she was convicted of felony fraud last year. a new court filing from federal prosecutor says that holmes booked a one-way flight to

mexico departing january. 26 2022. the documents also say holmes did not give notice of the travel nor did she get approval from the court. holmes partner william william evans went to mexico on january. 26 2022. and return to the u.s. on march 4th 2022. flying in from cape town, south africa. another rash of car break-ins in san francisco. this time it ghirardelli square. it happened earlier this afternoon conference gayle ong talked with a man who saw it all happen and she joins us live in the studio with the details. scale. >> la canada, that witness a film, the suspects breaking into cars. all of this happening over lunch. >> brooke, it bringing around 12:30pm, in the afternoon friday. a man could be seen reaching inside this parked vehicle at grit daily square. >> and then taking off in a getaway car. a witness captured it on video during lunch that like 6 cars. the witness did not want to share

his identity. he says he saw it all unfold from a nearby restaurant. this is the partner spa drain. >> it's been sitting in the vessel here and like and that really in. probably like missed. and i second we guys like stopping by. and even though i don't, he says he watched multiple car break-ins in a minute breaking into >> yeah, different different vehicle and then spoke to the victims were really upset right in the obr. make no sense of those. >> living by the law. all right. you people and just became over here. it's a nice day out and with their families and with their friends and nobody wants being in such a thing like. >> the witness says an undercover police officer was parked nearby and watched the suspects in action. but the officer did not try to stop the suspects, but i believe he just recorded could not going mean because they have guns. >> and they go that's going but i think, but it's

obviously is not being enough. and lived more than years and have seen this and my daughter. like not not getting better. this latest rash of auto smash-and-grab burglaries comes after nearly 2 dozen vehicle break-ins in the cow hollow neighborhood. san francisco supervisor catherine stefani who represents the cow hollow area told kron 4 this week. >> the city is short about 500 police officers and plans to push to make it a budget priority. the supervisor says she hopes a tougher on crime district attorney's office will make a difference. >> and that witness i spoke with says he gave sfpd the videos he found of the smash and grabs at road during delhi square. we reached out to sfpd about these latest break-ins but have not yet heard back in the studio. gayle ong kron. 4 news. thank you, gayle. >> the search for a college student who was swept out to sea in pacifica has been called off. police say the 22 year-old homs, all saudi, a student at san francisco state utiversity when missing

yesterday morning. he was swimmingcat the esplanade beach when 2 friends. but then he was hit by a large wave and then was swept out to sea. and experts say the rip currents and sneaker waves are dangerous any time of the year. but the winter months can be especially dangerous because of the shocking cold. >> knock you off your feet and then you can become disoriented. and that rip gets. it's real tough to swim in. >> the national weather service issued a coastal hazard warning for this coming weekend. they say because of the ongoing king tides, sneaker waves, rip currents and flooding are possible through monday afternoon. and we have kron four's chief meteorologist lawrence karnow joining us now with a look ahead. yeah, with that sunshine out there. we've still got storms out in the middle of pacific in there. >> generating a swell is moving along the coastline. see more of that throughout the weekend. tonight. a quiet night outside. it is a dry night around the bay area. but a coastal flood advisory remains in effect to the

weekend. in fact, all the way until 3 o'clock in the afternoon on monday. and that is due to a combination of the king tides and some large swells move it along the coastline was just checking some of the buoys and the running about 6 to 8 feet. so not gigantic. but these are strong. the waves that are coming certainly can knocking down off those rocks and drag you right back out of that cold water on that is extremely dangerous. something we have to watch out for 2 of tomorrow. the king tide rolling in effect tomorrow is going to be the largest of the king tide rolling in at over 7 feet by tomorrow morning. king tides going to stick around until monday as well. so expect some flooding along the coastal sections and some inundation even inside the bay. it looks like that will be going on right through monday with these tides running very high 10, 15 in the morning on saturday. you're going to see a tide over 7 feet. another one over 7 feet on sunday, too. >> thank you. or it's i know that ella is trying to contain her enthusiasm. this is a big one. less than 48 hours. the niners going to be going toe

>> welcome back. there was another wave of big tech layoffs in the bay area. google announced it will cut 12,000 positions today like other tech giants doing layoffs. google says it will pay u.s. employees during the 60 day notification period offering severance packages starting at 16 weeks. it will pay out all vacation time for 2022. health care will also be offered for the next 6 months. we spoke with some tech industry workers, his say they've been fired before and people are nervous about what comes next. >> my company had layoffs in in november that can be competitive in store during a downturn. so everybody kind of

jobs. the first of laid off by new year defying you've and i interviewed everywhere. when you add statement was pretty tough. >> we'll send our pitch. i issued a statement saying in part over the past 2 years we've seen periods of dramatic growth to match and feel that grows. we hired for a different economic reality than the one we face today. google ceo says that there will be a town hall on monday to answer any questions from former employees. >> the real estate market is as unpredictable as ever right now, at least according to market experts, what was a sellers market is quickly changing as interest rates climbed. kron four's theresa gives us a look at how conditions are different now and what tips experts have. if you're a buyer or a seller. >> shannon, who's been show this san francisco property to clients friday evening. >> as everybody's been talking about, virus market is so hot during the pandemic for sellers over now the last

couple of weeks, it slowly transitioning back into a seller's market. we're starting to see both offers on homes again, tough time for both buyers and sellers in this market. jeff tucker low explaining the data shows that the federal reserve's interest rate hikes to stave off inflation have really cool the market turning. what was a red hot seller's market to more of a buyer's market. >> but it isn't so simple. he says buyers can still face a lot of competition because it is also difficult for sellers. >> to find a new home. but, you know, >> you're selling your home and you can fetch a good price for it. if you're planning to move across town and buy your next home with a mortgage, you're probably trading in like a 3% interest rate for a 6% interest rate. so the mortgage rates are just kind of raining on everybody's parades at the moment. everybody is pointing to a crash 2008. i mean, everybody but actions are so different. we don't know. we just know what's going on right now and

we can try to their best estimate. what's going to happen in the future despite the pendulum swinging between the 2 sides. tucker has some advice. first. >> for sellers. >> getting the right price and actually getting it ready to sell. so putting your best foot forward. that means repainting touching up the paint. i'm getting the are getting it all cleaned up, getting it staged and photographed. well, all of those things are carrying more weight in a market like this. and for buyers make sure they find exactly the right moment. exactly the right neighborhood. >> and then. >> make sure you can afford it, you know, make sure that it is a home where with today's mortgage rates that fits inside your monthly budget, theresa kron. 4 news. >> take a look at this is a bay area dries out from the recent atmospheric river storm. the neighborhood in the city of remains threatened by a growing landslide home sitting on a hillside along cedar lane has been red tagged after it was pushed down along

with its deck, forcing families to evacuate another home on that street has been yellow tagged as city leaders trying to determine if the family can go back inside this week. officials are still investigating what led to the house sliding down the hillside in danville, maintenance crews have repaired more potholes in the past 2 weeks. >> then they typically cover up during a whole year maintenance services director dave casteel says the town averages about 100 pothole repairs a year. but 3 weeks into the new year, the town is already filled 150 potholes among the worst of the damage is on alameda diablo avenue at diablo road. the rain caused a large dip in the road making for some dangerous driving conditions. >> find out the pothole to even out the edges. and then for hot mix and go over with the roller to really compacted and get set in in the hot mix typically performs very well. and last for a long period of time. >> the pothole damage is widespread. residents are encouraged to report them using the danville connect app

as repairs continue drive carefully. so you don't end up in an auto body shop with an expensive repair. >> well, they're going to have a many sunny days ahead to get some more work right, philip, those potholes or so because we've got a nice break. yeah, they're all around the bay area, not just in danville, but we've got pothole actually, just about everywhere you go as this isn't just an incredible amount of rain today. the sunshine, though, showing up once again the second day in a row about that 2 dry days back to back. that is not bad. i'm able to say that in quite some time. and i think this weekend looking good to the skies are clear. cold out there tonight. there's no getting around that. a chilly night already around the bay area is 39 degrees in redwood city. 42 in san mateo right now. 41 in dublin. 35 in fairfax. 35 in calistoga. and now 39 degrees in sonoma. so getting cold out there tonight, going to be a chilly night around most of the bay area. but freeze warnings are going up in the

north bay once again, all the way up in the napa valley and then extending across the bay into the east bay, going to see those cold temperatures overnight. lows, 20's, some probably some 30's out there early on tomorrow morning. even inside the bay. we'll see those numbers dropping off into the 30's. so maybe a couple patches of frost inside the bay tomorrow morning. but these numbers, yeah, unusually cold. you bet. 32 degrees and live more freezing. 31 in santa rosa. 33 degrees in the bottle. and 33 in napa. so getting cold out there overnight tonight and probably the next few nights to as high pressure going to sit over head but also bring those clear skies and a bit of an offshore when we do have another storm system kind of knocking on the door here. but this ridge just too strong. it's going roll out there the system apart. send most energy well to the north and to see a couple clouds that across our skies tomorrow. but nothing too bad. otherwise dry out there. thas where it's going to stay here for the next 2 days. high pressure in control. that is going to kind of shred that system kind of falling apart. and that next ridge of high pressure gets ready to build in off the pacific. and that is going to settle in, i think, well, into next week that's going to keep

us dry, maybe for about 7 days after that looks like things start to transition again. maybe we start to talk about some more rain, 15 60's around the bay area for tomorrow afternoon. and then next couple days, we'll see lots of sunshine. great weekend ahead. we very dry week in a while that great weekend. of course, a lot of folks going to be indoors. well, we watch a little football. yeah. going on this weekend to yeah. it's more fun when it's raining to be inside watching football and miss a sunshine. but hey, finally, got you've got to do. there's some big games. yeah, huge. all thanks, >> well, the recent series of storms ez-pass california, parts of the golden state are still dealing with some other related problems related to the cold. well, it's causing some concerns for farmers in the central valley. but while some farmers say their are risks to losing entire crops, there is a silver lining to the freezing temperatures. >> this is actually for some crops such as almonds were tree fruit and some other types across are going go through a blue cycle here fairly soon. it helps to start off that from happening too early. it's helping to kind of

prolonged when the blue should start because we should see that closer to valentine's day. >> as for people, fresno opened up for warming centers, which will be accepting visitors through the end of the month. still ahead, an urgent warning from the treasury secretary. her prediction of what could happen. >> if congress can't reach a deal on the debt ceiling soon. >> regal cinemas is closing a number of their theaters across the country, including one right here in the bay area. we'll talk about which city will soon be losing its last movie theater.

>> new at 8 tonight, 5 people are in custody in connection to high and auto. seth said spanned several bay area counties. these are some of the items recovered by newark and san pablo. police say include 17 stolen vehicles, 12 firearms to ballistic armor vests and thousands of rounds of ammunition. police say the investigation started in november when the suspect vehicle was involved in a shooting in san pablo, detectives eventually identified and arrested. 5 suspects are all men in their 20's from the east bay. be a gun buyback event in will - fremont from 10 in the morning to 3 in the afternoon at the fremont fire department's tactical training center. you can get $100 for a handgun rifle or shotgun. $200 for an assault weapon payments are limited to $600 per person and will be given gift card while the supplies last. the department wants remind you

that the firearms must be in working condition and must be unloaded and taken in the trunk of your vehicle and ammunition will not be accepted. >> the parent company of the regal cinema chain is closing nearly 40 theaters across the country, including one right here in the bay area. regal, united artists theater in berkeley will be closing sometime next month. regal is the second largest theater chain in the u.s. its parent company cineworld filed for bankruptcy protection last year because of lingering effects of the pandemic. and oakland's police chief is placed on leave. we're hearing from the woman who used to have that job. welcome back

to kron. 4 news at 8. we're taking a live look outside of the golden gate bridge and we're going to find out if you're getting out of town this weekend. >> what's the weather going to be like? oh, my goodness. how about that? a dry weekend to get out and about this weekend looks great weather wise. not only here but all around the state. if you want to travel, we are looking good roadways open and clear. the sierra nevada looking great. of course, just a ton of snow in the high country. how the plates? yeah, looking pretty good as well. we have some blaze with all those big storms, but no delays at sfo. oakland or san jose. things are shaping up. great, clear skies out there now. clear and cold tomorrow morning in the monterey bay. temperatures by the afternoon 50's getting near 60 degrees in salinas. as you move further south into southern california. little

cold start by middle the afternoon. not bad. 65 downtown. los angeles. 63 in pasadena, pasadena and 66 in anaheim, high country. yeah, you've seen the snow up there. i mean, it is really been an epic start. the snow season, some places well, over 200% of normal. lot of snow up there tomorrow. high in a truck in tomorrow about 40 degrees. 41 in south lake. 36 in reynosa little chilly in spots. going to be colder, i think throughout the weekend. so that snow is not moving anywhere. it's not going to tell. you're talking about 30 degrees for a high on sunday as we head into monday, even colder. i think it could be a little bit windy on monday to a high then of 29 degrees. all right. out there tonight. we've got those nice clear skies settling in a cold night ahead. freeze warnings going up around the bay area. high pressure is holding on here and that's bringing us that nice offshore wind, too well to keep those skies mostly clear as we head throughout the night tonight and tomorrow, we'll see a lot of sunshine with just a couple high clouds drifting overhead. but then as we look out the

ahead, we're going to uee. well, probably a weekend and probably a nice dry week next week. pretty typical of the end of january. usually hit a kind of a dry spell. we certainly need that now. and then i think after them most are suggest we might see some changes coming our way. maybe we get back to some more rain by next weekend. so enjoy the sunshine while we 50's and 60's around the bay area. by tomorrow afternoon. the next couple days, plenty of sunshine coming our way. a little windy as we head into monday with that offshore wind staying dry in the next week. next weekend could be a different story. enjoy your sunshine while it sticks around. i love this view great. takes a look right? >> well, oakland's new mayor shane towers in washington, d.c., where she met with president biden. the president hosted a bipartisan group of mayors at the white house to help them better implement new federal laws at the local level during their winter conference in dc this week. mayor tao and other local leaders have shared their concerns with the administration about accessing infrastructure and covid funds. the american rescue

plan was passed to help cities recover from covid and cities are now competing for hundreds of different federal grants. >> treasury secretary janet yellen is warning of stark consequences for americans of lawmakers fail to raise the debt ceiling. the u.s. hit its debt limit yesterday, triggering, quote, extraordinary measures from the treasury department. those could allow the country to keep paying its bills until june. lawmakers don't agree to raise debt ceiling by then yellen says result could be a global economic crisis. yellen says the default on u.s. debt would cause a recession and every american would see their borrowing costs increase. 2023 is off to a busy start at the state capitol where lawmakers have already started to offer legislation on some key issues facing california kron four's capitol correspondent eytan wallace spoke with senate leaders from both sides of the aisle about their legislative priorities. >> homelessness, drought, water. those are just some of the issues. legislators here at the capitol hope to tackle

this year. but they acknowledged doing so will not be easy, especially with the projected budget deficit. >> top of mind, i'm incredibly optimistic, optimistic senate president pro tempore toni atkins says she's feeling about the year ahead scheduled for wednesday. the first woman and openly lgbtq+ person to serve as senate president pro tem atkins will soon mark 5 years in that role. now, part of the legislature considered one of the most diverse in california history. thanks. in part to a record, 50 win. >> we are representative of all the diversity of california. so that's a new energy, a new energy in the legislature that now must address a new challenge in the form of a projected 22.5 billion dollar deficit. >> facing the state in the next fiscal year. our hope is to avoid those kinds of serious cuts that we've had to deal with in in the last decade. when i got to the legislature 12 years ago, 26 billion dollar and then we had to make cuts. but she believes such serious cuts will be largely avoided this

time because of action the state has taken, including more than 30 billion dollars saved away for this type of scenario. i think we're better situated than we ever have been. despite all of the challenge, we have the highest reserves ever so that our goal will be to protect our progress, progress she hopes to make this year with investments on issues like housing. >> and climate, including drought floods and wildfire mitigation. but she says there's one issue in particular at the top of her list. homelessness is i just amazingly out of control. we are working very that. we have funds already allocated. we just need the implementation to get those funds in the communities where the work can be done. republicans where we're focused on fixing california senate minority leader brian jones says amid recent storms he and his gop colleagues want to see the state invest more in water storage. i would encourage the governor today under one of his executive orders start building the reservoirs on how to at least help close the

projected deficit. jones has this message for newsom, stop spending on the high speed rail and start spending on projects that californians need right now. roads, bridges, you know, we had 100 billion dollars surplus last year and we're swinging to a deficit in one year. that's unacceptable. and this all comes as the legislature is still technically get lulled into a week's long special session on oil prices. i'm told that special session could last several more weeks or even months reporting from the state capitol. eytan wallace. >> kron 4 news. >> coming up, a bay area woman makes history today in outer space. her story after the break.

into 2 incidents of misconduct committed by one police sergeant. this disciplinary action involving the oakland police chief is just the latest chapter in a long and complicated history for opd. the report released this week revealed the results of an investigation into 2 separate incidents that involved the same officer and fraud allegations that the internal affairs division is omitting misconduct from reports under the chiefs watch. armstrong is the city's 11th police chief in 14 years since 2009, no one has filled the position for more than 3 years. and kirkpatrick served as chief for 3 years between 2017 2020 when she was fired. >> that decision was made by the oakland police commission and she sued the city of oakland and she received a one and a half million dollar settlement. and and kirkpatrick now joins us live with her thoughts on this latest chief, as i'll call you, as former thanks for

joining us. what do you make of this whole situation where the current oakland police chief is on administrative leave because one officer was involved in a hit and run accident allegedly hit and run accident in his parking garage in san francisco and didn't report it. and then is accused of having his service revolver being fired in a freight elevator inside opd headquarters and not reporting that either. and then the chief apparently not taking any action against this officer for an extended period of time until this revelation just came out. what's going on over there? >> yes, well, first of all, thank you for having me on. and i miss you loved being in oakland and i did very much. it was still an honor to be the chief, a place of all planned. so i do miss with respect was going on over there. it's it was in a gracious of that the misconduct at issue was a gracious that has been determined to already be

sustained. and the unfortunate play that the current shape of place did not apparently do the level of due diligence that was necessary to make sure that the reports have been read. the questions have been asked and then the make a decision on his part as to whether or not to sustain underlying is what is the issue at hand. and so i can understand why the mayor made the decision that she did. it is not a final decision and we don't know what that final decision has, but it's unfortunate for him personally. chief armstrong and it's unfortunate for the department and of course, the community. is there any potential argument the chief could bring up in his defense? >> absolutely. i think this is due process situation. he should be given complete and full due process. and i don't know what that argument is. i do know that being placed on

administrative leave us a very significant step. >> i cannot think of and then just re about plan police shape that has been placed on administrative leave. i was not placed on administrative leave. >> outcome of do you think the chief will be able to return from something like this in the report is that he didn't read the review of that. the police sergeant who allegedly committed these 2 acts did not look at videotape that showed a the crash in particular. is this something that is chief can recover from an resume, his duties? i mean, it's going to be und%r a cloud moving for work. >> i think the clouds will be anytime that you have an event like you know, people are going to assign meaning to it and it will be very difficult for the recovery rate. can it happen? absolutely. and that's what due process is there for. but it is difficult to recover from because it had to do. i

believe the terminology that they used in the report was dereliction of duty and that has been sustained, which i understand was a stain is going to be difficult. you know what the final outcome would be. but, you know, that's why i feel sorry for and the department over. and although you can't really know what exactly you might say in his own defense, can you explain a little bit more about the inner workings of opd and any police department when it comes to particular situation like this. >> and at what point a police chief finds out about this kind of misconduct and then takes appropriate action thereafter. well, misconduct, they underline misconduct that hand was a gracious and of us. >> and in a pit it's it deserved the level of attention. i do know that when you're dealing with discipline matters, you're dealing with people and that could affect their and that is deserving of

your attention. reading the reports in asking the hard questions and some is not a significant, but but the issue at hand here was clearly a significant issue. so any time of it just deserves. but tension to reading the materials asking the questions, making sure that you're making you need to hold each other accountable it that's what the the failing as hears the lack of holding others accountable. what just different than my particular termination i was almost the reverse of that. we're always trying to hold others accountable. there was retaliation associated with that. but i was trying to report accountability. but without that, you're you're going you're never going to get to reform. >> we're running out of time. but on that you were the

former chief. we have a new mayor. we have new council members in oakland. things have changed since you left. i understand you might be open to the idea of returning to oakland to become at least the interim police chief while they sort through this process. >> i would love to be the nra buyout. tell your true. i did not want to leave oakland. i the new mayor. everybody has new leadership there. it is an opportunity for the city. the police department of the community to reset until they find what they want to was chief armstrong, if there was an 8 for an interim, of course, i would. i would return to oakland in the heart. 8. that's how much i very much enjoyed being in oakland, but job let's just first deal with what's happening right now in front the mayor and making a decision about the future for oakland. and one last question, what is your reaction to these calls now to remove internal investigations within opd? >> i actually have supported
